Synopsis

This piece explores the legal underpinnings for use of the incident command system, mutual aid agreements, and standard operating procedures in the context of a terrorism event involving hazardous materials. It emphasizes the need for these three elements to be considered as part of a single system in responding to disasters. The National Incident Management System (NIMS) embraces this approach. The article also explores potential liabilities under OSHA, negligence, and other legal theories that may result from failure to properly utilize these management tools.
